Agreement to Terms

By accessing or using AccessiMonitor's website accessibility monitoring service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

AccessiMonitor provides automated accessibility monitoring and reporting services for websites. We scan websites for WCAG compliance issues, provide reports, and may offer expert manual audits depending on your subscription tier.

Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Not share your account with others
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

Subscription Plans and Billing

Payment

Subscription fees are billed in advance on a monthly or yearly basis. All fees are non-refundable except as required by law. We use Stripe for payment processing and do not store your payment card information.

Route Definition

A "route" is defined as a stable URL path or template (e.g., /products/{sku}) that renders deterministically without user interaction beyond initial load. For template routes (e.g., product pages), we sample up to 5 instances per route. Pages that require authentication, infinite scroll, or multi-step interactions may count as 2 routes or be excluded by mutual agreement.

Route Discovery (Public Pages)

For public (non-authenticated) routes, AccessiMonitor automatically crawls your website starting from your homepage to discover pages up to your plan's route limit. We follow internal links and respect robots.txt directives. You can also manually specify routes to monitor in your dashboard.

Discovery process:

  • We start at your homepage and follow internal links
  • We discover routes up to your tier's cap (15, 40, or 100 routes)
  • You can manually add or remove routes at any time
  • We respect standard exclusion patterns (admin panels, development paths, etc.)

Authenticated Routes

Monitoring routes that require authentication (login-protected pages, user dashboards, etc.) requires additional setup. To monitor authenticated routes, you must provide:

  • Test credentials: A dedicated test account with appropriate access permissions
  • Authentication flow: Instructions on how to log in (e.g., username/password, OAuth flow, SSO)
  • Session management: Details on session duration and renewal if applicable
  • Route list: Specific URLs to monitor behind authentication

Authenticated routes may count as 2 routes each due to additional complexity. Please contact support to set up authenticated route monitoring. We handle all credentials securely and never store them in plain text.

Plan Limits and Add-ons

Each subscription plan has limits on:

  • Number of websites: How many websites you can monitor
  • Number of routes: Total routes across all your websites
  • Daily scan budget: Maximum scanning time per day (measured in minutes)
  • Features: Dashboard access, report exports (CSV/JSON), expert audits

If you need to monitor more routes than your plan allows, you can purchase add-on capacity to extend your limits without upgrading your entire plan.

Scan Caps and Safety Rails

To prevent runaway costs and ensure fair resource usage, we enforce the following caps:

  • Per-route scan timeout: Maximum 60 seconds per route. Scans exceeding this will be marked as "timeout"
  • Daily scan budget: Lite (30 minutes), Standard (90 minutes), Pro (220 minutes), Enterprise (unlimited)
  • Budget reset: Daily scan budgets reset at midnight UTC

If you exceed your daily scan budget, scans will be queued until the budget resets. We will notify you via email if you consistently approach or exceed your scan budget.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months or years.

Price Changes

We may change our pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

Code Fix Services

Our code fix packages are one-time projects with the following terms:

  • Payment is due upfront before work begins
  • Scope is limited to the number of issues specified in the package tier
  • We deliver fixes via pull requests or code patches
  • You are responsible for reviewing and deploying the fixes
  • One round of revisions is included for bugs or implementation issues
  • Additional fixes beyond the package scope require a new purchase

Acceptable Use

You agree not to:

  • Use the Service to monitor websites you don't own or have permission to monitor
  • Attempt to reverse engineer, decompile, or hack our Service
  • Use the Service for any illegal purpose
  • Overload our systems or attempt denial-of-service attacks
  • Resell or redistribute our Service without permission
  • Remove or obscure any proprietary notices

Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We may suspend the Service temporarily for maintenance, updates, or to address technical issues. We are not liable for any interruption of service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be error-free or uninterrupted
  • Warranties that scan results are 100% accurate or complete

Our automated scans are tools to assist with accessibility compliance but do not guarantee full WCAG compliance. Manual testing and expert review may be required.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSIMONITOR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages exceeding the amount you paid us in the past 12 months

Indemnification

You agree to indemnify and hold harmless AccessiMonitor from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you provide to us

Intellectual Property

All intellectual property rights in the Service, including software, documentation, and reports, belong to AccessiMonitor. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.

You retain all rights to your website content. By using our Service, you grant us permission to scan and analyze your website for the purpose of providing the Service.

Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Non-payment
  • Fraudulent or illegal activity
  • At our discretion with or without cause

Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days.

Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes will be resolved in the state or federal courts located in Wyoming.

For any disputes under $10,000, you agree to attempt good-faith resolution before filing any legal action.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and AccessiMonitor.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver.

Assignment: You may not assign these Terms. We may assign them without restriction.
